OAB SP broadens discussion on piracy and intellectual property rights

The São Paulo Chapter of the Brazilian Bar Association (OAB SP), through its Law Academic Commission, held a debate on ‘Piracy and Intellectual Property: Limits, Legislation and Collective Awareness’ last Tuesday (15), in the Noble Hall of the OAB SP, in downtown São Paulo. The event brought reflections and notes on piracy, copyright infringement, AI and how to protect this content in the face of innovations and technological changes in society, which have had an impact on the legal area.

The panel was made up of Aleksander Mendes Zakimi, president of the OAB SP Law Academic Commission, students Larissa Braga, Marcela Leitte and Pedro Soares Galvão, and featured a special appearance by lawyer Daniel Avila Failla, a specialist in business law, intellectual property and digital law.

Failla covered the basics of intellectual property and its main pillars, such as copyright, trademarks, patents, industrial design and software, as well as the role of the National Institute of Industrial Property (INPI), the body responsible for granting and registering these rights. He also pointed out the contemporary challenges related to piracy and artificial intelligence, which have caused profound transformations in the ways in which content is consumed, created and protected. In the end, the expert argued that more inclusive business models can broaden access and strengthen public engagement. According to him, it is essential to seek a balance between legal protection, social inclusion and adaptation to new technologies.

“As we’ve seen, the intellectual property system was created to encourage innovation, and that’s important for us as a society, it’s important for companies and the individuals who work with them. Companies are becoming increasingly digitalized and intellectual property is essential so that this ecosystem can be preserved and, in a way, innovation can always be encouraged. Thinking about AI, it’s going to be even more challenging, because it brings speed, dynamism to the development of new products and new ethical and legal issues that will need to be discussed and resolved quickly,” he concluded.

The chairman of the committee, Aleksander Mendes, said that the topic is becoming more present in everyday life, that it should be expanded within educational institutions and that the aim of holding the meeting was precisely to introduce the subject to students, paving the way for new possibilities in the legal profession.
