Federal Revenue Office seizes more than BRL 400 thousand in goods
On this Friday (24) morning, the Federal Revenue Office (RF) seized a tour bus on BR-135, leaving Montes Claros towards Bocaiúva, North of Minas, after finding a large amount of goods and import objects in the luggage compartments and inside the vehicle. According to the RF, the estimated value of the goods is at least BRL 400 thousand. Both the bus and the products were forwarded to the Federal Revenue Office’s Warehouse of Seized Goods in MOC.
Also according to the RF, the apprehension of the vehicle is provided by law, to the extent that, when approached, it was found that the goods were of foreign origin and were unaccompanied by their respective purchasers. Questioned, the employees of the tourism company did not present any documents proving the regular origin of the products. It is the carrier’s obligation to present the fiscal documents corresponding to the goods.
An administrative proceeding will be opened, when the company may present its defense. If irregularities are proven, a penalty of loss of goods and the vehicle itself may be declared. Furthermore, at the end of the procedure, it is possible that a tax representation will be drawn up for criminal purposes and sent to the Federal Public Prosecutor’s Office against the company and those responsible, who may be held criminally liable for their actions.
INTENSIFIED INSPECTION
The action is part of the monitoring work carried out by the RF and police forces on the main roads in the North of Minas. Through risk analysis and cross-checking of tax data, the Surveillance and Suppression of Smuggling and Embezzlement Division of the Federal Revenue Officestarts to monitor the movement of vehicles and people on roads with evidence of illicit activities such as smuggling and embezzlement. Next step, they are the target of approaches. In total, more than 12 buses were boarded during the inspection week.
DESTINATION OF THE GOODS
The legislation establishes that, once the confiscation penalty is imposed, the RF is responsible for disposing of the seized products. Among the alternatives is destruction, in the case of those products whose importation is prohibited. The same destination should be given to firearm replicas and cigarettes. In Minas Gerais, there are several RF projects in partnership with educational institutions that have been enabling the sustainable destruction of some of these items. Cigarettes, for example, are being transformed into fertilizer, and TV receivers into microcomputers.
They can also be added to an auction open to the public. The income should be reverted to the public coffers, being used in the provision of services and implementation of public policies.
Another option is the incorporation to the patrimony of public administration bodies and entities of the Union, the states and the municipalities. Finally, there is also the option for such goods to be donated to philanthropic entities.
